THE VOTE TO CLOSE HEARING – Affirmative: Chair Srinivasan, Vice-Chair Commissioner Chin and Commissioner Collins............4 Negative:.......................................................................0 THE VOTE TO GRANT – Affirmative: Chair Srinivasan, Vice-Chair Commissioner Chin and Commissioner Collins...........4 Negative:.......................................................................0 THE RESOLUTION – WHEREAS, the decision of the Queens Borough Commissioner, dated September 14, 2005, acting Department of Buildings Application No. 302003506, reads: “Proposed reduction of required accessory parking spaces for proposed office building the premises requires a special permit from New York City Board of Standards Appeals pursuant to Section 73-44 of Zoning Resolution”; and WHEREAS, this is an application under 73-44 and 73-03, to permit, within a C8-1 district, a reduction in the required number of accessory parking spaces for a proposed Use Group building from 36 to 18, contrary to Z.R. § 36-21; WHEREAS, a public hearing was held application on April 11, 2006, after due notice publication in The City Record, and then to closure decision on May 2, 2006; and WHEREAS, the premises and surrounding had a site and neighborhood examination committee of the Board, consisting of Chair Srinivasan, Vice-Chair Babbar, Commissioner Chin Commissioner Collins; and WHEREAS, Community Board 11, Brooklyn, recommends approval of this application; and WHEREAS, the subject lot is located Avenue, approximately 100 ft. east of Bath Avenue, and has a lot area of 12,005 sq. ft.; and 293-05-BZ CEQR #06-BSA-019BK submitted a statement regarding the operations proposed facility, which states that the building occupied by 35 employees, the majority of whom use mass transit to get to work; and WHEREAS, further, the facility will generate approximately 25 visitations per week, the majority of customer service provided employees of the facility shall be via telephone mail; and WHEREAS, based upon the above, the finds that, under the conditions and safeguards imposed, any hazard or disadvantage to the community at large due to the proposed special permit outweighed by the advantages to be derived community; and WHEREAS, therefore, the Board has determined that the evidence in the record supports the requisite findings pursuant to Z.R. §§ 73-44 and 73-03; WHEREAS, the project is classified as an action pursuant to pursuant to 6 NYCRR, Part 617.4; WHEREAS, the Board has conducted environmental review of the proposed action documented relevant information about the project Final Environmental Assessment Statement (EAS) No. 06BSA019K dated January 23, 2006; and WHEREAS, the EAS documents that the as proposed would not have significant adverse on Land Use, Zoning, and Public Socioeconomic Conditions; Community Facilities Services; Open Space; Shadows; Historic Resources; Urban Design and Visual Resources; Neighborhood Character; Natural Resources; Waterfront Revitalization Program; Infrastructure; Hazardous Materials; Solid Waste and Sanitation Services; Traffic and Parking; Transit and Pedestrians; Quality; Noise; and Public Health; and WHEREAS, no other significant effects upon environment that would require an Environmental Impact Statement are foreseeable; and WHEREAS, the Board has determined proposed action will not have a significant impact on the environment.
