THE VOTE TO GRANT – Affirmative: Chair Perlmutter, Vice-Chair Chanda and Commissioner Ottley-Brown.........................................3 Negative: ......................................................................0 Abstain: Commissioner Sheta………………………...1 THE RESOLUTION – WHEREAS, this is an application for a waiver of the Board’s Rules of Practice and Procedure and an amendment, extension of term and extension of time to obtain a certificate of occupancy of a variance, previously granted by the Board, which expired December 12, 2013; and WHEREAS, a public hearing was held on this application on November 15, 2016, after due notice by publication in The City Record, with a continued hearing on April 25, 2017, and then to decision on November 21, 2017; and WHEREAS, Community Board 12, Bronx, recommends approval of this application; and WHEREAS, the subject site is located on the north side of East 233rd Street, between Peters Place and Webster Avenue, in an R7A zoning district, in the Bronx; and WHEREAS, the site has approximately 76 feet of frontage along East 233rd Street, 191 feet of frontage along Peters Place, 192 feet of frontage along Webster Avenue, 19,570 square feet of lot area and is occupied by a gasoline service station and a one-story accessory convenience store; and WHEREAS, the Board has exercised jurisdiction over the subject site since December 10, 2002, when, under the subject calendar number, the Board granted a variance to permit the construction and operation of a gasoline service station and an accessory convenience store for a term of ten (10) years, expiring December 10, 2012, on condition that the proposal comply with the fire safety measures stated on the Proposed Conditions Site Plan (sheet 2 of 6) and that the above conditions be noted on the certificate of occupancy; and WHEREAS, the term of the variance having 227-02-BZ specifically waived by the Board remain in effect; THAT this approval is limited to the relief granted by the Board in response to objections cited and filed by the Department of Buildings; THAT the approved plans shall be considered approved only for the portions related to the specific relief granted; and THAT the Department of Buildings must ensure compliance with all other applicable provisions of the Zoning Resolution, the Administrative Code and any other relevant laws under its jurisdiction irrespective of plans or configurations not related to the relief granted.” Adopted by the Board of Standards and Appeals, November 21, 2017.
