THE VOTE TO GRANT – Affirmative: Chair Srinivasan, Vice Chair Commissioner Ottley-Brown, Commissioner and Commissioner Montanez ..........................................5 Negative:..........................................................................0 THE RESOLUTION – WHEREAS, the decision of the Borough Commissioner, dated June 7, 2012, Department of Buildings Application No. reads in pertinent part: #Physical Culture or health establishments#, including gymnasiums (not permitted Use Group 9) will require a special permit the Board of Standards and Appeals ZR 32-31; and WHEREAS, this is an application under 73-36 and 73-03, to permit, on a site within zoning district, the operation of a physical establishment (PCE) on a portion of the first, and third floors of a three-story commercial contrary to ZR § 32-31; and WHEREAS, the Board notes that the also includes an enlargement to the existing and mezzanine building to create a third floor; WHEREAS, the Board has not reviewed not take a position as to the zoning compliance enlargement, which the applicant represents right; any such enlargement is subject to DOB and approval; and WHEREAS, a public hearing was held application on November 15, 2012, after due publication in The City Record, and then to January 8, 2013; and WHEREAS, the premises and surrounding had site and neighborhood examinations Commissioner Montanez and Commissioner Brown; and WHEREAS, Community Board 1, recommends approval of this application on that (1) the hours of operation be limited to rather than midnight on weeknights, and (2) provide bicycle parking; and WHEREAS, the subject site is located northeast corner of Manhattan Avenue and Avenue in a C4-3A zoning district; and 209-12-BZ CEQR #13-BSA-002K concerns and are consistent with the measures Board has seen proposed for similar facilities; WHEREAS, the Board also notes that hours of operation are consistent with other in the area; and WHEREAS, accordingly, the Board finds action will neither 1) alter the essential character surrounding neighborhood; 2) impair development of adjacent properties; detrimental to the public welfare; and WHEREAS, the Board finds that, conditions and safeguards imposed, any disadvantage to the community at large proposed special permit use is outweighed advantages to be derived by the community; WHEREAS, therefore, the Board has that the evidence in the record supports the findings pursuant to ZR §§ 73-36 and 73-03; WHEREAS, the project is classified Unlisted action pursuant to 6 NYCRR Part WHEREAS, the Board has conducted environmental review of the proposed action documented relevant information about the the Final Environmental Assessment Statement, No. 13BSA002K, dated June 5, 2012; and WHEREAS, the EAS documents operation of the PCE would not have adverse impacts on Land Use, Zoning, Policy; Socioeconomic Conditions; Facilities and Services; Open Space; Shadows; Resources; Urban Design and Visual Neighborhood Character; Natural Hazardous Materials; Waterfront Revitalization Program; Infrastructure; Solid Waste and Services; Energy; Traffic and Parking; Pedestrians; Air Quality; Noise; Construction and Public Health; and WHEREAS, no other significant effects environment that would require an Environmental Impact Statement are foreseeable; and WHEREAS, the Board has determined proposed action will not have a significant impact on the environment.
