THE VOTE TO GRANT – Affirmative: Chair Srinivasan, Vice Chair Commissioner Ottley-Brown, Commissioner and Commissioner Montanez ..........................................5 Negative:...........................................................................0 THE RESOLUTION – WHEREAS, this is an application from Commissioner, requesting to modify the certificate occupancy of the subject premises to reflect requirement for an automatic wet sprinkler throughout all stairways and public hallways subject building; and WHEREAS¸ the Fire Commissioner proposes issue the following order to the property owner: You are hereby directed and required comply with the following order within (30) days. Install an approved automatic wet sprinkler system throughout the building arranged equipped as per the Building Code of NYC Administrative Code Chapter Administration, Section 28.010.1 and Title 28 Chapter 9 Section BC 903. Note: Plans shall be filed and approved the Department of Buildings before work commences. Authority: NYC Fire Code Chapter 9, Title 29, Section FC 901.4.3 of the Administrative Code, and Chapter 19 Section 487 Section 488 of the NYC Charter; and WHEREAS, a public hearing was held application on March 27, 2012, after due notice publication in the City Record, with continued on June 5, 2012, August 21, 2012 and October 16, and then to decision on November 20, 2012; and WHEREAS, the premises and surrounding site and neighborhood examinations by Chair Srinivasan, Vice-Chair Collins, Commissioner Hinkson, Commissioner Montanez, and Commissioner Brown; and WHEREAS, the subject premises is located 57th north side of West Street, between Ninth and avenues, within an R8 zoning district; and WHEREAS, the subject site is occupied by story residential building with retail use on the 163-11-A November 20, 2013; and WHEREAS, accordingly, the Board supports modification to the certificate of occupancy to reflect an automatic wet sprinkler system be maintained throughout all stairways and public halls in the building. Therefore it is Resolved that the application Fire Commissioner, dated October 12, 2011, seeking modification of Certificate of Occupancy No. 096814 hereby granted and the property owner must install sprinklers by May 20, 2013 and obtain a new Certificate of Occupancy by November 20, 2013.
