General Definition An unlicensed physical treatment establishment is any establishment that offers or advertises or is equipped or arranged so as to provide as part of its services, whether as a principal use or as an accessory use, massages, body rubs, alcohol rubs, baths or other similar treatment administered by a person that is not a healthcare professional licensed by the State of New York to provide such service, or under the supervision of such licensee and working in a manner allowed by the license. However, unlicensed physical treatment establishments shall not include barbershops or beauty parlors that offer massage to the scalp, the face, the neck or shoulders only. Unlicensed physical treatment establishments shall not be permitted in any District.
