New York City Zoning Resolution Section 106-53: Relationship to Public Improvement.
The City Planning Commission MUST reject any development application if the project would get in the way of an already-approved public improvement — like a planned road, park, or facility green-lit by the Board of Estimate, the Commission itself, or the Site Selection Board. Public projects already on the books take priority. No exceptions.
Section 106-53 - Relationship to Public Improvement
In all cases, the City Planning Commission shall deny any application whenever the development will interfere with a public improvement which has been approved by the Board of Estimate, the City Planning Commission, or the Site Selection Board.
