Refer Board of Standards & Appeals; and WHEREAS, this is an application extension of the term of a variance previously by the Board which expired on February 27, an amendment to legalize a recycling structure property; and WHEREAS, a public hearing was held application on November 8, 2018, after due publication in The City Record, with continued on May 21, 2019 and July 23, 2019, and decision on that same date; and WHEREAS, Vice-Chair Chanda, Commissioner Ottley-Brown and Commissioner Scibetta inspections of the subject site and surrounding neighborhood; and WHEREAS, Community Board recommends approval of this application; and WHEREAS, the subject site is bound Avenue to the south, 97th Place to the west, to the east, located partially within an R6B district and located partially within an R6A zoning district, in Queens; and WHEREAS, the site has approximately of frontage along 57th Avenue, 184 feet along 97th Place, 158 feet of frontage along 34,177 square feet of lot area and is occupied 81-74-BZ WHEREAS, on July 13, 1999, under calendar number, the Board further amended resolution to extend the term for ten (10) expire on February 27, 2007, and legalized enlargement of the storage area, on condition premises be kept clean of debris and landscaping be maintained in accordance approved plans; all lighting be pointed residential uses; the premises be maintained substantial compliance with the proposed submitted with the application; other than the resolution be complied with in all respects; new certificate of occupancy be obtained within year, by July 13, 2000; and WHEREAS, on April 24, 2007, under calendar number, the Board further amended resolution to extend the term for ten (10) expire on February 27, 2017, on condition substantially conform to the approved conditions be listed on the certificate of occupancy; site be maintained free of debris; all conditions prior resolutions not specifically waived by remain in effect; the approval be limited granted by the Board in response to specifically and filed DOB/other jurisdiction objection(s) DOB ensure compliance with all other provisions of the Zoning Resolution, the Administrative Code and any other relevant laws under its irrespective of plan(s)/configuration(s) not related relief granted; and WHEREAS, the term of the variance expired on February 27, 2017, the applicant (10) year extension of the term; and WHEREAS, the applicant also amendment to legalize a recycling machine the southeast corner of the subject site; and WHEREAS, over the course of hearings, Board raised concerns regarding the circulation site, the presence of the recycling machine at of the site facing the intersection, instead shielded location, and inaccurate signage shown plans; and WHEREAS, in response, the applicant the plans to add one (1) parking space and signage, and submitted plans for a proposed permanent recycling machine structure, satisfaction of the Board; a
