THE VOTE TO GRANT - Affirmative: Chairman Chin, Vice-Chair Babbar, Commissioner Caliendo and Commissioner Miele....4 Negative: ..................................................................0 THE RESOLUTION - WHEREAS, the applicant requested a waiver of the Rules of Practice and Procedure, a re-opening, an extension of the time to obtain a Certificate of Occupancy which expired on December 5, 2002; and WHEREAS, a public hearing was held on this application on April 8, 2003, after due notice by publication in The City Record, and laid over to May 6, 2003, June 24, 2003 and then to July 22, 2003 for decision; and Resolved, that the Board of Standards and Appeals, waives the Rules of Practice and Procedure, reopens and amends the resolution to extend the time to obtain a Certificate of Occupancy which expired on December 5, 2002, so that as amended this portion of the resolution shall read: "to permit the extension of the time to obtain a Certificate of Occupancy so that a new Certificate of Occupancy shall be obtained within two years from the date of this resolution, on condition THAT all work shall substantially conform to drawings as they apply to the objections above noted, filed with this application marked "Received July 15, 2003"- (1) sheet; and on further condition; THAT the premises shall be maintained free of debris and graffiti; THAT any graffiti located on the premises shall be removed within 48 hours; THAT the above conditions and all conditions from prior resolutions shall appear on the certificate A true copy of resolution adopted by the Board of Standards Printed in Bulletin No. 30, Vol. 88.
