THE VOTE TO GRANT – Affirmative: Chair Srinivasan, Vice Chair Collins, Commissioner Ottley-Brown, Commissioner Hinkson and Commissioner Montanez ................................................5 Negative:............................................................................0 THE RESOLUTION – WHEREAS, this is an application for a waiver of the Rules of Practice and Procedure, a reopening, and an extension of time to complete construction of a previously granted variance to permit, in an M2-1 zoning district, the construction of a four-story residential building with six dwelling units, which expired on August 22, 2010; and WHEREAS, a public hearing was held on this application on September 13, 2011, after due notice by publication in The City Record, and then to decision on September 27, 2011; and WHEREAS, the premises and surrounding area had site and neighborhood examinations by Chair Srinivasan and Commissioner Ottley-Brown; and WHEREAS, the subject site is located on the south side of Conover Street between King Street and Sullivan Street, within an M2-1 zoning district; and WHEREAS, the Board has exercised jurisdiction over the site since August 22, 2006 when, under the subject calendar number, the Board granted a variance to permit the proposed construction of a four-story residential building with six dwelling units, which did not comply with the underlying use regulations, contrary to ZR § 42-10; and WHEREAS, substantial construction was to be completed by August 22, 2010, in accordance with ZR § 72-23; and WHEREAS, the applicant states that due to financing delays, additional time is necessary to complete the project; thus, the applicant now requests an extension of time to complete construction; and A true copy of resolution adopted by the Board of Standards Printed in Bulletin No. 40, Vol. 96.
