THE VOTE TO GRANT – Affirmative: Chair Srinivasan, Vice-Chair Commissioner Collins..................................................3 Negative:......................................................................0 THE RESOLUTION: WHEREAS, the decision of the Queens Commissioner, dated November 17, 2005, Department of Buildings Application No. reads, in pertinent part: “A1- The proposed enlargement is partially located in the bed of street therefore no permit or Certificate of Occupancy can be issued as per Sect 35 of the General City Law”; WHEREAS, a public hearing was held application on August 22, 2006 after due publication in the City Record, and then to September 12, 2006; and WHEREAS, the subject site fronts on Beach Boulevard, and extends into a portion 52nd Street, which runs perpendicular to the and 52nd WHEREAS, Beach Street dead Rockaway Freeway where it is interrupted and again on the other side of the freeway; and WHEREAS, the proposed enlargement building at the site will increase the encroachment 52nd Street; and Beach WHEREAS, by letter dated April 27, 2006, Department states that it has reviewed the above and has no objections; and WHEREAS, by letter dated March 22, Department of Environmental Protection states reviewed the above project and has no objections; WHEREAS, the Department of Transportation (DOT), in a letter dated July 3, 2006, stated reviewed the application and concluded that the 52nd Street development will prevent Beach built to AASHTO standard width for additional capacity to accommodate future traffic generation 346-05-A by Section 35 of the General City Law, and appeal is granted, limited to the decision noted condition that construction shall substantially the drawing filed with the application marked December 6, 2005”-(1) sheet; that the proposal comply with all applicable zoning district requirements; and that all other applicable laws, rules, and shall be complied with; and on further condition: THAT this approval is limited to the relief by the Board in response to specifically cited DOB/other jurisdiction objection(s) only; THAT the approved plans shall be approved only for the portions related to the specific granted; and THAT the Department of Buildings compliance with all other applicable provisions Zoning Resolution, the Administrative Code and relevant laws under its jurisdiction irrespective plan(s)/configuration(s) not related to the relief Adopted by the Board of Standards and September 12, 2006.
