THE VOTE TO GRANT – Affirmative: Chair Perlmutter, Vice-Chair Commissioner Ottley-Brown and Sheta..............................................................................4 Negative: ......................................................................0 THE RESOLUTION – WHEREAS, this is an application the Board’s Rules of Practice and Procedure special permit, pursuant to ZR § 64-92, R4-1 zoning district, the reconstruction family detached residence in compliance resistant construction standards that does with the zoning requirements for front yards, rear yards, open space and lot coverage, §§ 23-45, 64-A351, 23-461(a), 64-A352, A353, 23-142, 64-A311; and WHEREAS, a public hearing was application on December 5, 2017, and on the same date; and WHEREAS, this application is brought of the property owner by the Build It which was created to assist New York affected by Superstorm Sandy; and WHEREAS, in furtherance of the rebuild residences impacted by Superstorm expeditiously and effectively, the Board, RCNY § 1-14.2, waives the following Practice and Procedure: (1) 2 RCNY (Objection Issued by the Department of 2 RCNY § 1-05.3 (Filing Period); (3) 2 (Application Referral); (4) 2 RCNY § 1-05.6 Notice); (5) 2 RCNY § 1-05.7 (List Property Owners); (6) 2 RCNY § 1-09.4 Authorization); and (7) 2 RCNY § 1-10.7 Service for Application Referral and Hearing and WHEREAS, the Board notes that application is exempt from fees pursuant 1-09.2 and NYC Admin. Code § 25-202(6); WHEREAS, the subject site is located side of Stanton Road, between Losee Gunnison Court, in an R4-1 zoning Brooklyn; and WHEREAS, the site has approximately frontage along Stanton Road, 55 feet square feet of lot area and is occupied family detached residence; and WHEREAS, the Board has exercised over the subject site since January 22, 2017-297-BZ CEQR #18-BSA-057K modifications, and that modifications are the necessary to allow for an appropriate building in compliance with resistant construction standards; (b) that any modification of bulk related to height is limited to than 10 feet in height or 10 permitted height as measured flood-resistant construction whichever is less; and (c) the proposed modifications will the essential character neighborhood in which the located, nor impair the future development of the surrounding consideration of the neighborhood’s potential development in with flood-resistant construction standards. The Board may prescribe appropriate conditions and safeguards to adverse effects on the character surrounding area; and WHEREAS, in accordance with the need to reconstruct the existing residence, it exists, is non-compliant with regulations front yards, rear yards, side yards, open coverage, creates practical difficulties with flood-resistant construction standards modification of the yard, open-space and requirements and that waiving the same necessary to allow for a building compliant resistant construction standards; and WHEREAS, the applicant notes finds that the proposal does not include modify the maximum permitted height in district; thus, the finding pursuant to ZR inapplicable in this case; and WHEREAS, the applicant states that, ZR § 64-92(c), the proposal will not alter character of the neighborhood in which located, nor impair the future use or development surrounding area in consideration of the potential development in accordance resistant construction standards; and WHEREAS, accordingly, the Board the proposal and determined that reconstruction satisfies all of the relevant
