ZR 23-662: Proposed Building comply with maximum height setback regulations per ZR 23-662 requires approval from the BSA; WHEREAS, this is an application § 72-21 to permit, on a site located zoning district, the construction of a Group 2 affordable independent residence (“AIRS”) that does not comply with regulations relating to floor area ratio height and set back, contrary to ZR §§ 662; and WHEREAS, this application is filed Catherine Sheridan Housing Development Company, Inc. (the “Applicant”), a Catholic Charities Progress of Peoples Corporation, the non-profit developer housing for its parent entity, Catholic Brooklyn and Queens (“Catholic Charities”); WHEREAS, Catholic Charities—whose is to provide housing and shelter for families, single adults, the elderly and populations supported by social developed over 3,500 units of social service low-income and senior housing in 2017-190-BZ CEQR #17-BSA-132Q BSA Cal. No. 237-77-BZ, the Board granted permit, pursuant to ZR § 73-451, construction and maintenance of an off-site facility accessory to a multiple dwelling 41 23rd Street (Block 568, Lot 12), condition that the parking facility be parking accessory to the multiple dwelling located at 31-41 23rd Street; there constructed at the site; that the lot be ownership with 31-41 23rd Street, to which was accessory; and that substantial construction completed within one year; and WHEREAS, by letter dated October letter of substantial compliance was issued change in use of the multiple dwelling located 23rd Street from Use Group 2 Class dwelling units and Use Group 4 community Use Group 2 AIRS, a use permitted as-of-right subject site and for which, pursuant to ZR accessory off-street parking spaces accordingly, the special permit granted site was surrendered; and WHEREAS, at the subject site, a area ratio of 2.20 (56,267 square feet of permitted pursuant to ZR § 23-155; a height of 40 feet and a maximum building feet are required pursuant to ZR § 23-662(a); above the maximum base height, setbacks feet are required from both 31st Road pursuant to ZR § 23-662(c)(1); and WHEREAS, the Applicant proposes the site with a six-story building containing affordable independent residences for seniors, superintendent’s unit for a total of 93 square feet of floor area including 6,328 accessory space on the ground floor for social and welfare services primarily residents, a floor area ratio (“FAR”) building height of 61’-8” with no setback 31st Road or 23rd Street; and WHEREAS, accordingly, the Applicant increase in the FAR permitted at the site 18,007 square foot increase in the residential permitted, a 21’-8” increase in the height permitted, an 11’-8” increase in building height permitted and a waiver 15 foot setbacks; there are no density applicable to AIRS units and, thus, no waiver has been requested; and WHEREAS, the Applicant submits waivers are re
