Proposed floor area ratio for a community facility in M1-4 zoning district portion the lot exceeds 6.5 FAR and is contrary ZR 43-122. The community facility does not have a maximum FAR in portion of the lot. 2. The proposed ambulatory diagnostic treatment health care facility located M3-2 zoning portion of the lot is permitted use as per ZR 42-12 (for zoning lot not existing prior to 1961). 3. Proposed structure 75 feet in 73rd along the street line of East Street not a permitted obstruction in the yard equivalent, contrary to ZR 43-28(b) and ZR 43-23(b). 4. Proposed 75 feet in height structure, 73rd along the street line of East Street not permitted in the Depth of Optional Front Ope n Area of 15 feet, alternate front setback, as per ZR 5. Proposed accessory parking for community facility in Community No. 8 in Manhattan exceeds 1 space 4,000 square feet of floor area, contrary to ZR 13-133; and WHEREAS, this is an application under 21, to permit, on a site partially within an M1-4 district and partially within an M3-2 zoning construction of a new community facility building 137-12-BZ CEQR #12-BSA-126M WHEREAS, the applicant proposes the uses: (1) the cellar level will be occupied accessory off-street parking; (2) the first floor occupied by the building entrance and main through-block drive lane to allow drop-off of patients, two loading berths to the west of through lane, and bulk oxygen storage to the drive-through lane; (3) the second floor occupied by the post-anesthesia care unit along visitor waiting area; (4) floors three through occupied by the operating floors, with six rooms per floor with ancillary facilities including operative holding, orthopedic surgical staging, support areas for doctors to perform surgery patient follow-up, and family waiting the sixth floor will be occupied by the sterilization facilities, as well as staff lockers areas; (6) the seventh floor will be occupied mechanical and building support facilities; eighth floor will be occupied by MRI facilities, ten examination rooms, five physician suites, and the proposed new teaching center; ninth floor will be occupied by rehabilitation, medicine, and occupational therapy departments; tenth through twelfth floors will be occupied additional X-Ray facilities as well as offices; and (10) the thirteenth floor will be mechanical systems; and WHEREAS, the applicant states that the building will have the following non-compliances non-conformance: (1) a floor area of 163,472 (8.00 FAR) (129,110 sq. ft. and an FAR of maximum permitted); (2) one rear yard equivalent 74th a depth of 20 feet along East Street (two with depths of 20 feet each or one open depth of 40 feet is required); (3) on the East frontage, a setback with a depth of five feet above the fifth floor (a setback of 15 feet along the frontage); (4) 98 parking spaces (a of 41 parking spaces is permitted); and (5) Use hospital use within the 571 sq. ft. of lot area 2 zoning district (Use Group 4 hospital permitted within the M3-2 zon
