A §72-21 variance is BSA relief from Zoning Resolution use or bulk requirements when strict compliance creates an unnecessary hardship unique to the applicant's lot. This is the hardship-based path — it is distinct from BSA §73 special permits (which are discretionary approvals of uses the ZR expressly contemplates in that district with special permit conditions). §72-21 is the harder path; §73 permits have higher historic grant rates.
Site survey, environmental review scoping, title work. Confirm BBL, district overlays, special purpose districts, FAR as-built vs as-of-right.
Applicant presents to the relevant CB zoning committee. CB advisory vote is non-binding but influences BSA's calculus heavily.
Form BSA-15 + supporting affidavits. Application fee, 4 hardship findings (financial + physical + uniqueness + minimum variance), environmental review (CEQR if applicable). BSA assigns a case number (format YYYY-XX-BZ).
Staff review for completeness. Public hearing scheduled (calendar typically 3-6 months out).
Decision: Grant, Grant with modifications, or Deny. Resolution posted with findings. Commissioners vote 5-0 / 4-1 etc.; supermajority not required.
