Zoning for Economic Opportunity
DCP framed the City of Yes for Economic Opportunity package around four goals: making it easier for businesses to find space and grow, boosting growing industries, creating business-friendly streetscapes, and adding new zoning tools to spur job growth. Each goal carries its own set of sub-proposals.
- Borough presidents Levine, Gibson, Reynoso, Richards recommended approval WITH CONDITIONS
- In response to community board concerns, barred conversion of space used for existing residential units; residential-to-commercial conversions cannot take advantage of the stacking-rule change
- Restricted specific uses from using proposed upper-floor allowances unless they meet additional environmental standards (noise and vibration limitations)
- Modified lab proposal in response to community board concerns about environmental protections and definition of objectionable effects; added explicit reference to the building code section currently used to regulate laboratories
- Modification: inserted language that presence of a dance floor is evidence an establishment is providing entertainment, giving enforcement agencies a tool to detect zoning violations; addresses concern that non-incidental dancing could bypass the 200-person threshold by not having a cover charge or showtime
- Zoning does not supersede individual building rules: lease agreements, co-op agreements, and other residential legal documents supersede zoning and can place additional limitations
